Who may run payroll in Botswana

Payroll in Botswana in practice

Botswana disconcerts European employers by an absence: the country has no national social security fund with compulsory contributions. There is accordingly no social certificate to produce and no enrolment to arrange with a public pension body. Retirement cover runs through private pension funds supervised by the non-bank financial regulator, and is a matter of company policy rather than law.

What remains on the payslip is essentially fiscal: tax withheld at source on wages and remitted to the Botswana Unified Revenue Service (BURS), together with a levy earmarked for vocational training.

English is the official and administrative language, with Setswana the national language in everyday use. Wages are paid in pula. Finally, while payroll is not a reserved activity, the Botswana Institute of Chartered Accountants (BICA) is a statutory regulator rather than a mere association: accounting firms must be registered with it.

Employing staff in Botswana

Enrolling an employee in a pension scheme is not a legal obligation but an employer's choice. If you set up a pension fund, its rules and its authorisation must be examined, since there is no public safety net to fall back on.

The right to work, by contrast, drives the timetable. Botswana operates an employment policy favouring national labour, and hiring a foreign employee requires a work permit together with a residence permit; that procedure weighs on a project far more than incorporation itself.

The entity is obtained from the companies and intellectual property authority. Check that the now-required filings have been made, in particular the beneficial ownership declaration, whose absence blocks later steps.

Tax registration and the identification number that comes with it are indispensable to any filing.

A written contract is strongly advisable and its content is framed by employment legislation dealing with working time, leave and dismissal.

Tax withheld, the training levy and, where applicable, contributions to the company pension fund appear on the payslip.

Notice, terminal benefits and the handing over of documents are dealt with together on exit rather than one after another; for a foreign employee, cancellation of the permit is added to the list.

What sets Botswana apart

The absence of a national social scheme remains the most unsettling point. Do not look for a contributions certificate: the BURS tax clearance certificate, which covers withholding on wages, takes its place. A local provider promising a social certificate does not know its own country.

BICA occupies an unusual position in the professional landscape. It issues practising certificates, registers firms and runs quality control: it is a regulator, which makes its register directly usable as a selection criterion.

Recent transparency obligations, finally, have become useful beyond their own purpose. The beneficial ownership declaration filed with the companies authority is now a routine document, and it is the best available tool for verifying who really owns a candidate firm, in a country where ownership structures crossing into South Africa are common.
