Payroll in China: a restricted activity

The country lies outside the European Union and outside the European Economic Area: the A1 certificate has no standing there. Whether the employee remains in the scheme of origin then depends on the bilateral social security agreement, if any, concluded with the sending country; where no such agreement exists, dual affiliation must be expected and budgeted into the assignment.

Who may run payroll in China

The answer to this question changes everything: it determines to whom you may entrust your payslips locally, and what you must ask for before signing. It has been verified country by country with the local authorities.

In China, running payroll on behalf of third parties is a regulated activity. It is carried on under the title of 代理记账机构 (agence agréée de tenue de comptabilité) ; personnel titulaire du 会计专业技术资格, and a registration in force must be produced to you before any engagement.

What to check on the ground

La tenue de comptabilité pour compte de tiers, qui englobe en pratique l'établissement de la paie et des déclarations fiscales et sociales associées, est une activité soumise à agrément préalable du bureau des finances local (代理记账管理办法, arrêté MoF n° 98 de 2019). Un cabinet non agréé ne peut légalement facturer ce service. À distinguer du 会计师事务所 (cabinet d'audit, agrément distinct pour l'audit légal).

Payroll in China in practice

No multilateral social security coordination system covers China. The country has, however, signed bilateral agreements with several European states, France among them, which exempt posted employees from certain branches of Chinese contributions. The benefit is never automatic: it depends on a certificate obtained before departure.

The renminbi is the currency of pay, transferred to a Chinese bank account. Chinese is the language of the employment contract; bilingual versions are common, but the Chinese text is what governs before local authorities and courts. Contribution bases and the housing fund are set city by city, which rules out any national approach: Shanghai, Beijing and Shenzhen are not managed the same way.

Third-party bookkeeping, which in practice covers payroll and the related filings, requires prior approval from the local finance bureau. Unlike Anglo-Saxon markets, China therefore imposes a genuine regulatory barrier to entry. That approval is verifiable online, and it is the first thing to look at.

Employing staff in China

Without a Chinese company, a foreign business cannot hire a local employee directly: it works through a locally incorporated structure, usually a wholly foreign-owned enterprise, or through an intermediated employment arrangement whose robustness deserves scrutiny before it is adopted.

Employer accounts are then opened with local authorities, covering social insurance registration and registration with the housing provident fund (住房公积金), both administered at municipal level. Since collection of social contributions passed to the tax authorities, most filings and certificates are handled through the provincial electronic tax portal.

Contract form is prescribed and writing is mandatory; an employer that has not obtained a signed contract within the statutory window faces a specific penalty. Review the term, the probation period, confidentiality, and where relevant the non-compete clause, which is valid only if compensation is paid after the employee leaves.

Withholding individual income tax on wages falls to the employer, who reports it monthly and reconciles it once a year. The end of the relationship is prepared early: termination is permitted only on an exhaustive list of grounds, and statutory severance is calculated by reference to length of service. Working time arrangements deserve attention too, since several regimes coexist and some require administrative approval before they may be applied.

What sets China apart

Data transfer is settled before the first payroll run. The Personal Information Protection Law tightly controls the export of employee data from China: depending on volumes and processing, a company either files a standard contract with the provincial branch of the Cyberspace Administration of China (国家互联网信息办公室), obtains a certification, or undergoes a security assessment. Sending payroll files to a European head office is anything but routine.

The housing provident fund is the other matter to settle in advance. It is an employer charge with no European equivalent, administered locally and kept entirely separate from social insurance.

A recurring confusion of labels compounds all this. Licensed bookkeeping agencies (代理记账公司), audit firms (会计师事务所) and holders of a human resources services licence operate under three different approvals. Only the first may lawfully invoice payroll services.

Points to watch in China

Vérifier systématiquement l'existence et la validité de l'agrément 代理记账许可证书 sur la plateforme nationale du ministère des Finances : c'est le seul contrôle vraiment discriminant, beaucoup de prestataires se présentant comme comptables sans le détenir. Appellations concurrentes à ne pas confondre : 代理记账公司 (agence de tenue de comptabilité, agrément MoF), 会计师事务所 (cabinet d'expertise comptable/audit, agrément distinct) et 人力资源服务许可证 (licence de services RH, délivrée par le 人社局, requise pour le placement de personnel et le portage salarial mais pas pour la paie). Le recouvrement des cotisations sociales ayant été transféré au fisc en 2019, les attestations fiscales et sociales s'obtiennent désormais au même guichet électronique provincial.

The Chinese checkpoint is singular and non-negotiable: the bookkeeping agency licence (代理记账许可证书) issued by the local finance bureau, verifiable on the Ministry of Finance national platform. We further ask for the business licence (营业执照) bearing the unified social credit code, the tax and social security certificates obtained through the provincial electronic portal, and a written answer on the mechanism adopted for transferring personal data out of China. The legal representative's name must match the public register exactly. Dated screenshots from the public registers are expected alongside the documents themselves.
