Local payroll and social security compliance in Spain

Who may run payroll in Spain

The answer to this question changes everything: it determines to whom you may entrust your payslips locally, and what you must ask for before signing. It has been verified country by country with the local authorities.

In Spain, running payroll on behalf of third parties is reserved by law to no registered profession: any company may take it on. The absence of a legal barrier shifts the checking onto you, and that is why the network itself verifies the registration, the tax and social security standing and the insurance cover of every firm before listing it.

What to check on the ground

L'établissement de la paie et des cotisations pour compte de tiers est libre en Espagne : aucune inscription obligatoire. Le titre protégé est celui de Graduado Social, réservé aux diplômés inscrits à un Colegio Oficial ; il ouvre le monopole de la représentation technique de l'employeur devant les juridictions sociales et impose une assurance RC. La transmission des données à la Seguridad Social se fait via le Sistema RED / SILTRA, ce qui suppose une autorisation RED délivrée par la TGSS au cabinet agissant comme « autorizado RED ».

Payroll in Spain in practice

Spain is professionally open and technically well structured. Providing payroll for third parties requires no compulsory registration: an asesoría laboral may do so freely. The protected title of Graduado Social, by contrast, unlocks technical representation of the employer before the social courts, which makes it a criterion to examine as soon as a partner claims to handle employment litigation on your behalf.

Spain belongs to the Union and to the European Economic Area: coordination rules apply automatically, and a posting is evidenced by an A1 certificate. Wages are settled in euro. Contractual documents are written in Castilian, alongside the co-official language in several autonomous communities.

The most operational feature concerns data transmission: contributions and staff movements pass through the Sistema RED, access to which requires an authorisation granted by the Tesorería General de la Seguridad Social (general social security treasury). Without that authorisation, a firm can transmit nothing on behalf of a third party.

Employing staff in Spain

Affiliation of each employee and notification of their arrival come before work actually begins: late notification is among the most consistently penalised failures in Spanish practice. Employer registration opens, for that purpose, a contribution account code specific to the province and to the activity.

Incorporating is not obligatory for all that. Obtaining a tax identification number and registering as an employer with the social security system is enough; the route is workable, but it requires appointing a representative in Spain and holding a means of electronic identification.

The applicable collective agreement, sectoral and often provincial, sets job classifications, minimum pay, working time and frequently contractual bonuses. It is determined by actual activity, not chosen for convenience. Written contracts are required for most contract types and must be communicated to the public employment service.

Payslips follow an official model and must show how contributions are apportioned. Income tax withholding is compulsory, at a personalised rate, with periodic remittances and an annual summary. Grounds for dismissal, finally, are categorised, each carrying its own compensation regime, and the characterisation set out in the dismissal letter is decisive if the matter is later litigated. Working time records are mandatory for all employees and are among the first items an inspector asks to see.

What sets Spain apart

Spanish collective agreements are frequently concluded at provincial level, so the same activity may be governed by different texts in Madrid and in Barcelona. An employer applying its head office agreement to an employee based elsewhere is working from the wrong reference.

Remuneration also includes, under virtually every agreement, additional monthly payments made during the year. They may be spread across the year where the agreement permits, but their existence is not open to negotiation.

A document little known outside Spain governs the checking of a provider: the certificado de situación censal, which sets out the filing obligations actually registered and the declared economic activity code. It shows whether a candidate genuinely carries on accounting and employment administration work rather than holding a corporate purpose that exists only on paper. All three checks can be carried out remotely and quickly.

Point n°3 : attention aux appellations concurrentes — « gestoría », « asesoría laboral », « despacho profesional » et « consultoría » ne recouvrent aucune qualification légale, contrairement à « Graduado Social colegiado ».

The most discriminating item in Spain is not a qualification but an authorisation: the Sistema RED authorisation issued by the Tesorería General de la Seguridad Social, without which a firm cannot transmit a client's contributions. Then come the Registro Mercantil nota simple, the certificado de situación censal, registration in the intra-Community operators register, tax and social security clearance certificates, and professional liability cover. Proof of registration as a Graduado Social is required where the firm offers representation before the social courts.
