Bolivian employment law is codified, formal and markedly protective of employees, and the administrative document often matters as much as the parties' agreement. A foreign company hiring in La Paz, Santa Cruz de la Sierra or Cochabamba first encounters a fragmented institutional landscape: health cover sits with the Caja Nacional de Salud (CNS, national health fund), while pensions are handled by the Gestora Pública de la Seguridad Social de Largo Plazo, the public long-term social security manager that replaced the former private pension funds. The Ministry of Labour, for its part, keeps its own employer register.

The country belongs to no monetary union. The boliviano is the currency in which wages are settled, and local exchange controls make payment in foreign currency impractical. Spanish is the language of contracts, payslips and every document filed with the authorities.

Running payroll for a third party is not a reserved activity; signing financial statements, however, is restricted to holders of a licence from the Colegio de Auditores o Contadores Públicos de Bolivia (CAUB), the professional body for auditors and public accountants.

Registration on the Registro Obligatorio de Empleadores kept by the Ministry of Labour conditions the filing of payroll schedules, and foreign employers frequently discover it too late. Without it the whole reporting chain stalls.

Nor does Bolivia offer any light-touch route to employment without a local presence: employer registration, employee enrolment and periodic filings all presuppose an entity recorded with the Servicio Plurinacional de Registro de Comercio and holding a tax identification number.

Enrolment happens in two stages, with the health fund and then with the pension manager, each having its own forms and its own deadlines, so neither enrolment can be assumed to follow from the other.

Drafted in Spanish, the employment contract may, depending on its type, need to be presented to the Ministry of Labour: settle that point before signature rather than after, since a contract already signed is harder to adjust to the ministry's expectations.

The employer withholds the employee's personal tax at source, and cash payment is poorly regarded by the authorities. Payroll schedules follow a Ministry of Labour calendar distinct from tax and social deadlines.

Termination is the most sensitive area of Bolivian law. There is no flexible equivalent to redundancy, reinstatement is a genuine outcome, and severance is computed on a length of service that must have been tracked from the outset.

The commercial register is no longer run by FUNDEMPRESA but by SEPREC, and pensions are no longer managed by private funds but by the public Gestora. Both shifts are recent: documents and procedures predating them still circulate, although they now carry no weight and should not be accepted in support of a file.

Beyond the statutory annual bonus, a further year-end payment may be decreed by the government depending on national economic performance. The cost is therefore not known in advance, cannot be budgeted from the previous year's figures alone, and should be provisioned cautiously.

The Ministry of Labour, finally, does not merely inspect: it registers employers, receives payroll schedules and intervenes in individual disputes. A provider who knows only the health fund and the tax authority is covering just part of your obligations, and the missing part is the one that generates most of the correspondence.
