Belgium belongs to the European Union and to the European Economic Area, so the EU coordination rules apply: a single social security legislation is designated, and an employee posted from France may, subject to conditions, remain covered by the home scheme on the strength of an A1 certificate. Remuneration is denominated in euros.

The first Belgian complication is linguistic. Three official languages coexist, Dutch, French and German, and the language of employment documents is not a matter of choice between the parties: it follows the location of the operating unit that employs the worker. A contract drafted in the wrong language risks being set aside, a risk employers usually discover only once a dispute has started.

The second feature is institutional. Belgium invented the accredited social secretariat for employers, a body approved by ministerial order that files declarations with the Office National de Sécurité Sociale (ONSS, RSZ in Dutch). Third-party payroll is therefore supervised rather than strictly reserved: it may be carried out by an accredited secretariat or by an agent registered with the ONSS.

Identify first the joint committee governing your activity. That sector body sets pay scales, allowances, contractual notice periods and often a year-end bonus. Foreign employers overlook it more often than any other item, and it is the costliest to put right afterwards.

Local presence is settled next. A foreign company may register as an employer with the ONSS without setting up a subsidiary, but that route carries tax and practical consequences best settled before the first hire.

Employer registration precedes Dimona, the immediate declaration of entry into service, which must itself be filed before work actually begins. The employee is affiliated through that channel, and from the very first hire you must take out accident-at-work cover with an approved insurer: this is not optional. Deal at the same moment with the written contract, required for certain forms of engagement, and with its language, which follows the operating region.

Pay is subject to professional withholding tax deducted at source and remitted to the tax administration. The quarterly multifunctional return, DmfA, reports remuneration and contributions due to the ONSS. A payslip must be issued at each pay date.

Notice periods are calculated by length of service, and several termination documents must be produced, including form C4 for unemployment insurance purposes. Decide in advance who will draw them up.

The accredited social secretariat has no equivalent elsewhere: Belgium has institutionalised payroll outsourcing, with approval granted by ministerial order and the secretariat bearing its own responsibility towards the ONSS. No other European state has built such a status.

Every employer also falls under a sector joint committee whose collective agreement overrides many of the parties' contractual choices; a misclassification distorts payroll from the very first payslip and is difficult to unwind afterwards.

The documentary side matters mainly when selecting a partner. The Crossroads Bank for Enterprises issues a free extract with no official standing and a paid extract obtained through an accredited business counter; only the latter is authoritative. Likewise the ONSS produces two similarly named certificates, one for public procurement and one on social debts: state clearly which you require.
