Guinea occupies an unusual position in West Africa: it is governed by OHADA law, like its neighbours, but belongs neither to the West African monetary union nor to the CIMA insurance market. The Guinean franc is a national currency whose value rests on no fixed parity, which directly exposes a pay policy designed from Europe.

French is the language of the administration, of contracts and of payslips, which lightens the translation burden while saying nothing about differences of substance. Employee social protection is handled by the Guinean Caisse Nationale de Sécurité Sociale (CNSS), with which the employer registers before hiring.

Payroll work for third parties is not a reserved activity: it falls within freedom of trade, subject to an appropriate corporate object on the register. The title of expert-comptable is protected throughout the OHADA area, although the Guinean professional body is difficult to verify from abroad, which shifts the assessment onto other evidence.

Registration as an employer with the CNSS opens the social file, together with the individual affiliation of each employee.

Upstream of that, the private investment promotion agency runs the investor one-stop shop and centralises incorporation: entry on the trade and personal property credit register, then allocation of the tax identification number by the national tax directorate. The decision on local presence is taken there.

Written and drafted in French, the contract calls for two checks: that the conditions for using a fixed-term contract genuinely match the role performed, and that the prior formalities for employing a foreign national have been completed.

Wage withholding tax is operated by the employer for the tax administration, separately from social contributions and on its own deadlines. Ask precisely what form the payslip takes, how it is delivered and retained, and how variable pay and benefits in kind are brought into the calculation.

Two matters finally call for particular attention: the mining sector, which applies its own agreements and local content requirements, and termination, where procedure and severance must be documented before any decision is taken rather than justified afterwards. Repatriation of payroll archives is worth providing for in the engagement letter, since reconstituting them locally after the event is rarely straightforward.

Only partial membership of the regional groupings governs how the country reads. Reflexes acquired in Abidjan or Dakar do not transpose mechanically, particularly on insurance, since Guinea sits outside the CIMA zone: a professional indemnity certificate issued within that framework needs to be read carefully.

Online traceability, next, is weak. The investment promotion agency maintains a business directory that carries no registration value, and confusing it with the commercial register is a common error; verification here requires direct contact with the administrations concerned.

Mining, finally, structures a large share of formal employment and imposes contractual practices, pay scales and local recruitment obligations that payroll has to reflect, including for staff seconded by foreign contractors. Those requirements are found in the agreement applicable to the site rather than in the labour code alone, so the analysis has to start from the operation itself.
