Employment contract and termination in Turkey

In Turkey, the drafting of the employment contract commits the payroll for its whole duration: the language used, the form adopted and the mandatory particulars are fixed by local law, not by the practice of head office.

Termination is the moment when drafting errors are paid for. Final settlement, notice, severance and exit documents obey local rules that the payroll manager applies every month: it is that person, and not the legal department at head office, who spots a poorly drawn contract. Having the model contract reviewed by the firm that will run the payroll costs little and avoids most disputes.

Severance pay is the decisive Turkish peculiarity. It is calculated on length of service and on a reference salary, and it falls due in many termination scenarios, including at the employee's initiative in cases the law provides for. A foreign employer must provision for it from the first hire, or else discover a liability it never budgeted.

Türkiye has also retained a requirement for data controllers to register in advance with a public register maintained by the data protection authority, an obligation the European Union abolished. A payroll operator is almost always caught by it, and registration can be checked online.

A minimum fee scale is published each year by the union of chambers, and it is enforceable. An offer well below that scale signals an irregular arrangement rather than a bargain.

Point non vérifié faute d'accès à la page officielle : les seuils exacts d'assujettissement au VERBİS, régulièrement révisés par la KVKK, doivent être reconfirmés à la date du dossier.
