Employment contract and termination in Saudi Arabia

In Saudi Arabia, the drafting of the employment contract commits the payroll for its whole duration: the language used, the form adopted and the mandatory particulars are fixed by local law, not by the practice of head office.

Termination is the moment when drafting errors are paid for. Final settlement, notice, severance and exit documents obey local rules that the payroll manager applies every month: it is that person, and not the legal department at head office, who spots a poorly drawn contract. Having the model contract reviewed by the firm that will run the payroll costs little and avoids most disputes.

Saudisation policy is the most structural feature: a company is placed in a compliance band according to the share of nationals in its workforce, and that ranking effectively governs renewal of visas and work permits. It is a public indicator of an employer's, or a provider's, capacity to endure in the country.

Payment monitoring follows closely. The wage protection system automatically reconciles transfers against declared contracts, so a payroll delay becomes immediately visible to the administration.

Reading a Saudi file starts, finally, with expiry dates. The commercial registration, the investment licence, chamber membership and the tax certificate each carry a deadline, and an expired document causes rejection regardless of the candidate's actual standing. Taken together, the three say more about a Saudi counterparty than any commercial presentation, and each of them is publicly verifiable.
